01Purpose of this manual

PAIA gives you the right to request access to records held by a private body, where you need the record to exercise or protect a right. This manual is prepared under section 51 of PAIA. It tells you what records Ask Andre holds, how to ask for them, and what to do if access is refused.

Ask Andre is the personal business of Andre van Niekerk, a registered property practitioner (PPRA FFC No. 1267613) who works as an independent contractor with the estate agency Trust Property. Trust Property is a separate body. It has its own records and its own PAIA obligations. This manual covers only the records Andre van Niekerk holds himself, such as the information collected through askandre.co.za.

07How to request access to a record

  1. Complete Form 2 (Request for Access to Record). It is available from the Information Regulator: Form 2.
  2. Send it to the Information Officer by email or post (section 02).
  3. On the form, identify the record you want with enough detail for it to be found, state who you are, give an email or postal address, say what form of access you want, and say which right you need the record to exercise or protect. If you are asking on behalf of someone else, attach proof that you may do so.
  4. You may be asked to prove your identity before access is given.

If you do not use Form 2, the request may be delayed or refused.

Requests are decided case by case, and the answer is given in writing. PAIA allows 30 days to respond. A record may be refused on the grounds PAIA lists, for example to protect another person’s privacy or commercial information.

08Fees

PAIA allows fees for a request and for access to a record. The fees are set by the Information Regulator, and this manual does not set its own amounts. See the Regulator’s PAIA fees structure. If a fee is payable, you will be told in writing on Form 3 (Outcome of request and of fees payable).

09If your request is refused

You may complain to the Information Regulator or apply to a court. PAIA gives you 180 days from the decision to do so. There is no internal appeal against a private body’s decision.
