01Who we are
This website, askandre.co.za, is operated by Andre van Niekerk, a registered property practitioner (PPRA FFC No. 1267613) affiliated with Trust Property. For the purposes of the Protection of Personal Information Act 4 of 2013 (POPIA), Andre van Niekerk is the responsible party and the appointed Information Officer.
02What personal information we collect
We collect only what you choose to give us:
- Lead and enquiry forms: your name, phone number and email address, plus any details you add about your property enquiry.
- Newsletter sign-up: your email address, and a record of when and where you agreed to receive the newsletter.
- Consultation bookings: your name, email address and any answers you give when you book a free property consultation through Calendly.
- WhatsApp messages: your phone number, name as shown on WhatsApp, and the content of the messages you send us.
- Website traffic data: usage data collected through Google Analytics, which uses a random ID and not your name or contact details (see section 6).
- Advertising data: information about your visit and actions on this site, such as pages viewed or a form submitted, collected through the Meta Pixel and sent to Meta (see section 6).
03Why we collect it
We collect your information to respond to your property enquiry and to deal with you about the property services you asked about. We do not use it for any unrelated purpose.
04How your information is stored and shared
Form submissions are sent through this website (WPForms) to a Google Sheet that Andre van Niekerk controls, and the lead’s details are also uploaded to PropCon, the client management system of Trust Property, which holds that copy in its own system. WhatsApp messages are held in the WhatsApp account used for this business. If you subscribe to the newsletter, your email address is held in Brevo, the email service used to send it.
We do not sell your personal information. We share it with third parties only in these cases: Trust Property receives the lead information described above and, where a transaction goes ahead, the information needed to conclude it; Google (Google Sheets and Google Analytics), Brevo, Calendly (consultation bookings), hCaptcha (spam checks on forms) and YouTube (embedded videos, in privacy-enhanced mode) process information on our behalf; and the Meta Pixel sends website activity data to Meta (see section 6). Google, Meta, Brevo, Calendly, hCaptcha and WhatsApp may process information on servers outside South Africa.
We take reasonable technical and organisational measures to protect your information against loss, damage and unauthorised access, as POPIA requires.
05How long we keep it
- Enquiries that don’t go further: 12 months after our last contact, then deleted from the Google Sheet, WhatsApp, email and Calendly.
- Clients (where a mandate is signed or a transaction goes ahead): 5 years after the transaction is concluded or the business relationship ends, as the Financial Intelligence Centre Act (section 23) requires. Then deleted.
- Newsletter subscribers: until you unsubscribe. Your address is then removed from the mailing list straight away; a record that you unsubscribed is kept so you’re not added again.
- Website analytics: Google Analytics keeps event data for 14 months.
- Cookie consent records: 12 months.
- Testimonial consent: for as long as the testimonial is published, plus 12 months.
You can ask for your information to be deleted earlier by emailing hello@askandre.co.za, unless the law requires us to keep it.
06Google Analytics and the Meta Pixel
Google Analytics measures how many people visit the site and which pages they read. It does not store your name or contact details, and we do not use it to identify you personally.
The Meta Pixel sends information about your visit and actions on this site to Meta, so we can measure how our Facebook and Instagram ads perform. Meta can link this information to your Facebook or Instagram account if you are logged in. Meta handles that data under its own privacy policy (facebook.com/privacy/policy), and we do not control what Meta does with it.
Google and Meta may process this data on servers outside South Africa. See our Cookie Notice for the cookies involved and how to block them.
07Your rights
Under POPIA you have the right to:
- ask whether we hold personal information about you, and request access to it;
- ask us to correct information that is inaccurate or out of date;
- ask us to delete your information, or object to us processing it.
To use any of these rights, email hello@askandre.co.za. We will respond within a reasonable time. Data that Meta holds about you through the Meta Pixel is managed through your Meta account settings.
If you believe we have handled your information unlawfully and we have not resolved your concern, you may lodge a complaint with the Information Regulator (South Africa) at inforegulator.org.za.
